Volunteer Liability Waiver

Waiver of Liability, Assumption of Risk, and Indemnity Agreement

The Trap-Neuter-Return-Manage (TNRM) program is the only method proven to be humane and effective at controlling outdoor cat population growth. Using this technique, all the cats in a colony are trapped, vaccinated, possibly treated for select injury or illness, neutered, ear-tipped for identification, and then returned to their territory. The goal of any community cat management program is to maximize the quality of life for the cats and to eliminate the existing colony over time through attrition

This agreement releases Visalia Feral Cat Coalition Inc from any and all liability surrounding that care. 

Assumption of Risks: Working with feral cats carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid said risk to VFCC volunteers. (Never attempt to touch a conscious feral/stray cat. Do not stick fingers into traps or carriers containing cats. Both cats and kittens may bite. Always wear heavy gloves when transporting stray cats. If you should be bitten by a cat (or any animal caught in the trap), the bite should be examined by a doctor within 24 hours) The specific risks vary from one activity to another, but the risks range from 

1) minor injuries such as scratches, bruises, and cuts

2) major injuries such as bites and seizures

3) catastrophic injuries such as paralysis and death. 

Thank you for offering your time to volunteer with Visalia Feral Cat Coalition Inc. The work we do for the feral cats would not be possible without the help of our volunteers. Please read through the agreement below, complete the form at the bottom and return it to a Board member. 

  1. I acknowledge that I have voluntarily agreed to serve as a volunteer for Visalia Feral Cat Coalition Inc, a nonprofit corporation organized under the laws of the State of California. 
  2. As a Volunteer I will be contributing my time and effort to various services for Visalia Feral Cat Coalition Inc. The services will be performed by me as assigned by an officer, director of another volunteer of VFCC. In the course of performing the services, I agree: To disclose any physical or psychological limitations to appropriate directors or officers before participating in any activity. Since I may be interacting with feral cats I may be lifting, carrying, moving or otherwise engaging in physical labor, I will be respectful of my own limitations and will inform VFCC immediately of such limitations. To obey all safety rules and regulations. In the interest of the safety of the cats, the public, and other volunteers I acknowledge that VFCC has the right to revoke volunteer privileges if these rules and regulations are not followed. 
  3. I agree to provide my services without compensation. I agree that I am not and will not become an employee, agent, contractor or principal of Visalia Feral Cat Coalition Inc upon execution of this agreement. 
  4. I hereby agree to be legally and financially responsible and will indemnify and hold Visalia Feral Cat Coalition Inc harmless  for my own acts and omissions relating to the service I am voluntarily providing to VFCC. I acknowledge that I am responsible for providing my own medical, liability, and auto insurance, copays and deductibles during my volunteer service. I understand that I am not covered by workers’ compensation nor insured by VFCC during the performance of my volunteer duties and tasks. 
  5. I am voluntarily participating in the activities of Visalia Feral Cat Coalition Inc with full knowledge of the risks and dangers involved and hereby agree to accept all risks of injury, death or damage to myself and/or my personal property. As a Volunteer, I may come into contact with and interact with feral cats, and such work entails risk of personal injury due. These risks include, but are not limited to everything listed in this document. 
  6. I understand that as a Volunteer of Visalia Feral Cat Coalition Inc, I may be recorded on film, video or other electronic recording media. I hereby consent to such recording and the use by VFCC of any recorded images or other media recordings of my name and likeness (“A-V Recordings”) for any purpose related to furtherance of the objectives of VFCC. In particular, I grant VFCC permission to copyright and use, reuse, publish and republish A-V Recordings, for art, advertising, or other purposes.
  7. As consideration for being permitted by Visalia Feral Cat Coalition Inc to participate in activities and provide services, I hereby agree that I, my assignees, heirs, guardians, and legal representatives will not make a claim against or sue VFCC for injury or damage resulting from my participation in activities and performance of services.  
  8. I acknowledge that this agreement will apply for the entire term of my volunteer relationship starting with the date I first perform volunteer duties for Visalia Feral Cat Coalition Inc, even if it predates the date of this agreement, and continuing as long as I continue to be a Volunteer and thereafter as is necessary to protect the interests and rights of VFCC. I understand that my participation as a volunteer with VFCC is contingent upon my agreeing to this waiver. 
  9. I agree that I am not a minor unless accompanied by a patent or guardian.  If under 18, myself and my parent or guardian agree that I will not under any condition touch a cat even if it seems tame. 

I hereby release and agree to hold Visalia Feral Cat Coalition Inc harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the clinic, or that may otherwise arise in any way in connection with any services received from VFCC.

I have read this Waiver of Liability, Assumption of Risk, and Indemnity Agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I confirm that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.  This Agreement shall be governed by the laws of the State of California, and any disputes arising out of or in connection with this Agreement shall be under the exclusive jurisdiction of the Courts of the State of California.
